Terms of Service

These terms set out the rules for using You Matter More, the app, the website and the coaching and training services provided through them. By creating an account, by subscribing, or by using any part of this site, you agree to these terms. Please read section 4 in particular, because it is about your safety.
1. Who we are
You Matter More is a fitness coaching and training service operated by Henry James, a sole trader trading as You Matter More, based in Huddersfield, West Yorkshire, United Kingdom.

In these terms, "we", "us" and "our" mean You Matter More. "You" means the person using the service.
2. Who can use this service
- You must be 18 or over to create an account or to buy anything on this site. By registering you confirm you are 18 or over.
- 16 and 17 year olds may train with us in person only, and only where a parent or guardian has completed and signed our youth waiver and health screening beforehand. They do not hold an account, and a parent or guardian remains responsible for them throughout.
- We do not provide services to anyone under 16.
3. Your account
You are responsible for keeping your login details secure and for any activity under your account. Give accurate information when you register and keep it up to date, particularly anything about your health. Accounts are personal to you and must not be shared. Tell us promptly if you think your account has been accessed without permission.
4. Health, safety and the limits of what we do
This is the most important section. It applies to everyone who uses any part of You Matter More, whether you pay us or not, and whether or not you have ever spoken to Henry.
- You exercise at your own risk. Physical exercise carries an inherent risk of injury, including serious injury. By using any workout, programme, exercise demonstration, video or other training content on this site, you accept that risk.
- Nothing here is medical advice. None of the content on You Matter More is medical, physiotherapy or clinical advice, and none of it is a substitute for consulting a doctor, physiotherapist, registered dietitian or other qualified healthcare professional.
- What Henry is qualified to do. Henry is a Level 3 qualified Personal Trainer. He is not a doctor, physiotherapist, sports therapist, dietitian or nutritionist, and nothing he provides should be treated as if he were. He does not diagnose, treat or rehabilitate injuries or medical conditions.
- Get clearance if any of this applies to you. Speak to your GP before starting, if you have an injury or a history of injury, a heart condition, high blood pressure, dizziness or chest pain, diabetes, a joint or back problem, if you are pregnant or recently gave birth, if you are taking medication that affects exercise, or if you have not exercised for a long time.
- You are responsible for how you train. That means working within your own limits, choosing a load and a progression you can control, warming up properly, checking that any equipment you use is safe and suitable, training in a safe space, and stopping immediately if you feel pain, dizziness or anything that is not normal effort.
- Tell us if things change. If you are coached by us, you agree to keep us informed of any change to your health, injuries or medication that could affect your training.
- Screening. Before any coaching or in-person training begins you will complete a health screening questionnaire (PAR-Q) and, for in-person training, a separate liability waiver. You agree to answer honestly and fully. If your answers indicate you should get medical clearance first, you agree to do so before starting. The terms of that waiver form part of your agreement with us.
Free and Premium users of the app are not individually screened or assessed by us. If you use the app without being coached by us, you are choosing your own training and taking responsibility for whether it is appropriate for you.
5. The exercise library and third party content
The app includes an exercise library: a reference collection of movements with demonstrations, notes and progressions.
- It is a reference, not a prescription. Nothing in the library is a personalised recommendation to you. It does not take account of your injuries, your experience, your equipment or your circumstances, because it was not written for you. Deciding whether a movement is appropriate and safe for you is your decision, and if you are unsure, do not attempt it.
- Some demonstrations are other people's videos. Where we have no footage of our own, the library embeds videos published publicly on third party platforms such as YouTube, shown through that platform's own official player and credited to whoever made them.
- We do not own, control or endorse that content. Those videos are the property of the people who made them. We did not produce them, we cannot change them, we are not responsible for what they say or show, and we do not warrant that the technique demonstrated is correct or appropriate for you. Their creators may edit or remove them at any time, and their platform's own terms and privacy policy apply when you play them.
- Attempting a movement you have seen in the library is your own decision, made at your own risk, exactly as set out in section 4.
- If you are the owner of a video embedded here and you would rather it was not, email henry@youmattermore.co.uk and we will remove it promptly.
Paying for Premium pays for our own programming, structure, notes and the app around it. It does not buy access to third party videos, which are freely available on the platforms that host them.
6. Nutrition, macros and food data
- Calorie and macro targets shown in the app are general estimates produced by a formula, not a prescribed diet, and not clinical nutrition advice.
- Recipes and nutrition figures are provided in good faith but are approximate. Ingredients, brands and portion sizes vary.
- Food and barcode data comes from third party databases and is contributed by the public. It can be incomplete, out of date or simply wrong. Do not rely on it for allergen information. If you have a food allergy or intolerance, always check the actual packaging.
- If you have or have had an eating disorder, are pregnant or breastfeeding, or have a medical condition affected by diet, please speak to a doctor or registered dietitian before following any nutrition information here.
7. The YMM AI assistant
Premium includes an AI assistant that can answer questions about the app and your own logged data.
- It gives automated responses generated by a third party AI model. It is not Henry, and it is not a person.
- It can be wrong, incomplete or out of date. Do not rely on it for anything that matters without checking, and do not act on it as if it were advice.
- It is instructed not to give training or nutrition advice and not to comment on your body, your eating or your progress. If it ever does, that is a fault, not a service, and we would be grateful if you reported it.
- Nothing it says is medical, health, legal or financial advice.
- To answer your questions it sends some of your account information to our AI provider. Our Privacy Policy explains what and to whom.
- If you are struggling with your health, your relationship with food, or your mental health, please speak to a real person: your GP, or a qualified professional. Henry is happy to be told, but he is not qualified to treat it.
8. Coaching services
Where you sign up for online coaching or personal training, we provide the service described at the point of sign-up. Coaching is collaborative, and results depend on many things including your own effort, consistency, sleep, nutrition, genetics and circumstances. We do not guarantee any specific result, and any example or testimonial on this site is one person's experience rather than a promise of yours.
Online coaching is delivered remotely. We cannot see you train, so we rely on what you tell us and on the videos you send. That makes your honesty about form, pain and capability part of how the service stays safe.
9. In-person personal training sessions
The following applies to 1-to-1 personal training with Henry at The Unit Fitness, Halifax.
Monthly training. Training is sold as a monthly package: one, two or three sessions a week, at a regular slot agreed between you and Henry. Payment is monthly in advance by standing order from your own bank, set up when you first meet. There is no minimum term, no joining fee and no exit fee. It is rolling month to month, and you can stop at any time by cancelling the standing order. Please also tell Henry, so your slot can be released.
What a monthly package includes. Your sessions at The Unit Fitness, workouts in the You Matter More app for the days you train on your own, full access to the app, and your calorie and macro targets. Two sessions a week and above also includes a monthly check-in and progress review. Three sessions a week also includes priority messaging for questions and form checks between sessions.
Moving a session. Give at least 24 hours' notice and Henry will offer you another slot in the same month wherever his diary allows. If no slot can be found, one session may be carried into the following month. Only one session may be carried at a time, and a carried session must be used in that following month. A session cancelled with less than 24 hours' notice, or one you do not attend, counts as used.
Pausing. If you are away, tell Henry at least two weeks in advance and your month can be paused by agreement. Pausing is not automatic and depends on Henry being able to hold your slot.
Stopping. If you cancel your standing order part way through a month you have already paid for, you keep that month's remaining sessions. Part months are not refunded, and unused sessions have no cash value.
One-off sessions. Paid by bank transfer before the session. Cancel 48 or more hours before for a full refund; cancel 24 to 48 hours before for a half refund; cancel under 24 hours before, or miss the session, and it is non-refundable.
If Henry cancels. If Henry ever has to cancel a session, it will be rearranged at no cost to you, or that session will be credited to the following month. Genuine illness and emergencies on your side will always be handled fairly, at Henry's discretion.
Gym entry. If you are not a member of The Unit Fitness, a £5 gym entry fee per session is payable directly to the gym. That fee is the gym's, not Henry's, and is not included in any package price.
The gym itself. While training at The Unit Fitness you are also subject to that gym's own rules and its own liability arrangements. The gym's premises and equipment are its responsibility, not ours.
10. Subscriptions, payment and cancellation
This section applies to anything you buy through the website, currently Premium and online coaching. In-person personal training is covered by section 9 instead.
- Prices. The price and what the plan includes are shown before you buy. Prices include VAT where applicable. We are not currently VAT registered, so no VAT is charged.
- Payment provider. Payments are processed by Stripe. We never see or store your full card details.
- Recurring billing. Subscriptions renew automatically at the end of each billing period, monthly or yearly depending on the plan you chose, at the price shown when you signed up, until you cancel. Your renewal date is shown on your plan page.
- Cancelling. You can cancel at any time from your plan page, with no notice period and no exit fee. Cancelling stops the next payment. You keep access until the end of the period you have already paid for, and you are not charged again after that.
- Yearly plans. We will email you a reminder before a yearly plan renews. If a yearly plan renews and you tell us within 14 days that you did not want it and you have not meaningfully used it in that period, we will refund it.
- Your 14 day cancellation right. Because you are buying online, UK law gives you 14 days from purchase to change your mind and get a refund. By starting to use a digital subscription straight away you are asking us to begin immediately, and you accept that you lose that automatic right once you have. In practice we would rather you were not paying for something you are not using, so if you are inside 14 days and you ask, we will refund you, less anything already delivered.
- Refunds beyond that. Outside the situations above, subscription payments already taken are not normally refunded, and part months are not refunded. If something has gone genuinely wrong, email Henry. He would rather sort it than have you out of pocket.
- Failed payments. If a payment fails, we or Stripe may retry it. If it keeps failing, paid features may be suspended until it is resolved.
- Price changes. If we change the price of a plan, we will tell you before it affects you, and you can cancel before the new price applies. Founding coaching clients keep the rate they signed up at for as long as they stay subscribed without a break.
- Nothing here affects your statutory rights under UK consumer law.
11. Acceptable use
When using the platform, you agree not to:
- Share your account, or resell or give away access to others.
- Copy, redistribute, resell or republish our programmes, recipes, exercise library or other content.
- Download, re-host or scrape any content, including third party videos, from the platform.
- Post abusive, unlawful, discriminatory or harmful content anywhere on the platform.
- Upload a photo or video of anyone other than yourself without their permission.
- Attempt to disrupt, hack, overload or misuse the platform, or use it to break the law.
12. Our content and intellectual property
The programmes, recipes, written content, library notes, branding, design and code of You Matter More are our intellectual property, or are used with permission, and are provided for your own personal, non-commercial use only. You may not reproduce or distribute them without our permission.
Third party content shown on the platform, including embedded videos, remains the property of its owner and is used as described in section 5.
13. Your content
If you upload progress photos, form check videos or other content, you keep ownership of them. You grant us permission to store them and to use them solely to deliver your coaching, for example to review your technique or track your progress. We will never use your photos or videos for marketing, or share them publicly, without your separate and explicit consent. Feedback you give us is only ever quoted publicly if you have ticked the box saying we may, and credited the way you asked.
14. Availability and changes to the service
We do our best to keep the platform running, but we do not guarantee it will be available without interruption or free of errors. Features may be added, changed or withdrawn as the service develops. If we withdraw something significant that you are paying for, you can cancel and we will refund the unused part of your current period. We are not liable for loss caused by the service being unavailable, though we will always try to put things right.
15. Limitation of liability
To the fullest extent permitted by law:
- We are not liable for injury, loss or damage arising from your use of the service where you have not followed guidance given to you, have not disclosed relevant health information, have exercised beyond your capabilities, or have attempted something the service did not recommend to you personally.
- We are not liable for the accuracy of third party content, third party food or nutrition data, or AI generated responses, as described in sections 5, 6 and 7.
- We are not liable for indirect or consequential loss, or for loss of data, profit or opportunity.
- Where we are found liable for something, our total liability to you is limited to the amount you have paid us in the twelve months before the event.
Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by our negligence, for fraud, or for your statutory rights as a consumer.
16. Ending your access
You can close your account at any time. We may suspend or end your access if you breach these terms, if you behave abusively toward Henry or anyone else, or if we reasonably believe you are putting yourself or others at risk. If your account ends, your right to use the service stops, and the sections on liability, intellectual property and acceptable use continue to apply.
17. If something goes wrong
If you are unhappy with anything, email henry@youmattermore.co.uk and Henry will reply personally. Most things are sorted with a conversation. If you are not satisfied with the outcome, you may be able to use an alternative dispute resolution scheme, and you can always go to the courts.
18. Changes to these terms
We may update these terms from time to time. The "last updated" date shows when they last changed, and we will tell you about anything significant. Continued use after a change means you accept the updated terms.
19. Governing law
These terms are governed by the laws of England and Wales, and any disputes will be subject to the courts of England and Wales.
